Limited Product Warranty

Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

The warranty set out below is provided by FM8 Pty Ltd in addition to, and does not exclude, restrict, or modify, the consumer guarantees and other rights and remedies you have under the Australian Consumer Law or any other applicable law. Nothing in this warranty limits or excludes those rights.

1. Warranty Scope

FM8 Pty Ltd ("the Company") warrants to the original purchaser ("the Customer") that its products are free from defects in materials and workmanship for the standard warranty period of 12 months from the date of dispatch.

For specific components identified by the Company (e.g., high-wear items such as belts, rollers, or wear strips), an extended pro-rata warranty may apply. The terms and duration of any pro-rata warranty will be clearly stated on the product's data sheet or sales invoice.

2. Pro-Rata Warranty Terms (Where Applicable)

If a pro-rata warranty is specified for a product, it is structured as follows:

  • Initial Period (e.g., first 6 months): 100% replacement for verified manufacturing defects.
  • Pro-Rata Period (e.g., remaining 6 months up to a 12 month total): Replacement is provided on a pro-rata basis, calculated based on the percentage of the total warranty life that has been consumed. The Customer will be invoiced for the consumed portion of the product's current list price.

Example: If a 1-year pro-rata warranty product fails after 9 months, 9/12 (66.6%) of the warranty life is used. The Customer would be responsible for 66.6% of the current replacement cost.

3. Warranty Claims & Process

To initiate a warranty claim, the Customer must:

  • Notify the Company in writing (via email to info@fm8.global) within the applicable warranty period.
  • Provide a detailed description of the alleged defect and supporting evidence (e.g., photos, video).
  • Provide proof of purchase (invoice number and date).
  • If requested by the Company, return the product freight-prepaid for inspection.

Upon validation of the claim, the Company will, at its sole discretion, either:

  • Repair the defective product;
  • Replace the defective product (under the standard or pro-rata terms as applicable); or
  • Refund the purchase price of the defective product.

Where a product suffers a major failure (as defined under the Australian Consumer Law), the Customer may choose a refund or replacement instead of the above, and may also be entitled to compensation for other reasonably foreseeable loss or damage.

4. Exclusions & Limitations

This warranty does not apply to defects or damage resulting from:

  • Improper installation, operation, or maintenance not in accordance with the Company's published guidelines.
  • Use of the product with non-FM8 components that cause damage or are incompatible.
  • Normal wear and tear, corrosion, or deterioration.
  • Accident, misuse, abuse, neglect, modification, or alteration.
  • Operation outside of the product's specified design limits or environmental conditions.

For pro-rata warranties, failure due to normal wear life is excluded and covered only under the pro-rata terms in section 2.

These exclusions apply to the warranty given in this document and do not affect any consumer guarantee that cannot be excluded under the Australian Consumer Law.

5. Liability

To the maximum extent permitted by law, and subject always to the consumer guarantees under the Australian Consumer Law referred to above, the Company's liability for a breach of this warranty is limited, at the Company's option, to repairing the goods, replacing the goods, or paying the cost of having the goods repaired or replaced. This limitation does not apply where the goods are of a kind ordinarily acquired for personal, domestic, or household use, or where it would not be fair or reasonable for the Company to rely on it.

7. Governing Law

This warranty is governed by and construed in accordance with the laws of Queensland, Australia.
